Employee Pay

Employers are free to set the compensation of individual workers at any amount they choose. Subject decisions are, however, subject to wage and hour and non-discrimination laws and rules. For example:

  • Employers may pay workers at any rate that equals or exceeds minimum wage unless the work is exempt from minimum wage under both Montana and federal law.
  • Employers may choose any method of payment including hourly, salary, piece work, or commissions. All such payment are converted to their hourly equivalent for minimum wage compliance purposes.
  • Employers must pay workers overtime, regardless of the method of payment of wages, unless the work is exempt from overtime under both Montana and federal law. Payment on a salary basis does not automatically classify a worker as exempt from overtime.
  • Employers may be required to comply with valid orders to withhold (Garnish) a portion of any employees pay. Such witholding ordders may result from:
  • Employer must pay their employees by cash or check, unless the employe has “opted in” to electronic payment of wages. Electronic wage payments must conform to the rules published by the Department of Labor and Industry.

Government Contractors

  • Employees who work under contracts with the federal government may be subject to prevailing wages. The US Department of labor sets minimum pay rates in such cases.
